Privacy Policy OverviewAnyplace Inc. (“Anyplace”, “we” or “us”) provides this Privacy Policy to inform you of our policies and procedures regarding the collection, use, and disclosure of Personal Information (defined below) that we receive from users of www.Anyplace.com (the “Site”).This Privacy Policy applies only to information that you provide to us through the Site. This Privacy Policy may be updated from time to time, and we may update this Privacy Policy to reflect changes to our privacy practices. If we make any material changes, we will notify you by email (sent to the e-mail address specified in your Anyplace Account) or by means of a notice on the Site prior to the change becoming effective. We encourage you to periodically review this page for the latest information on our privacy practices.Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Service. As used in this Privacy Policy, the terms “using” and “processing” information include using cookies on a computer, subjecting the information to statistical or other analysis and using or handling information in any way, including, without limitation, collecting, storing, evaluating, modifying, deleting, using, combining, disclosing and transferring information within our organization.
Information Collection and UseOur primary goals in collecting information are to provide and improve our Site, Services, features and content, to administer your use of the Site and Services and to enable us to assist the Members in using the Accommodation. We collect information that identifies, relates to, describes, references, and is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“Personal Information”). In particular, we will collect, and have collected in the last twelve (12) months, the following categories of Personal Information from you:(1) Identity Information and Billing InformationWhen you register with us through the Site and become a Member, as well as when you book Accommodation, we will ask you for personally identifiable information. This refers to information about you that can be used to contact or identify you (“Identity Information”). Identity Information includes, without limitation, your name, phone number, email address, and home postal address, but does not include your credit card number or billing information. In order to process some of your transactions through the Site, we may also ask for your credit card number and other billing information (“Billing Information”). We also collect the other information that you provide to us as part of the registration process and the administration and personalization of your Anyplace Account profile (including, without limitation, any individual preferences or demographic information) (collectively, “Ancillary Information”). Ancillary Information shall also be treated as Personal Information in the event that it is found to fall under the definition of Personal Information in this Privacy Policy. We use your Personal Information to provide the Services and administer your inquiries. We collect Personal Information in connection with your registration to join the Services. You can register to join via the Site by completing the required forms. We may aggregate your Personal Information with information collected from other Members and non-registered users browsing the Site (“Anyplace Users”) to attempt to provide you with a better experience, to improve the quality and value of the Services and to analyze and understand how our Site and Services are used. We may also use the combined information without aggregating it to serve you specifically, for instance to deliver a product to you according to your preferences or restrictions. We also use your Personal Information to contact you with Anyplace newsletters, marketing or promotional materials and other information that may be of interest to you. Please note that we may also use your Personal Information to contact you with information related to your use of the Services.(2) Log DataWhen an Anyplace User visits our Site, our servers automatically record information that your browser sends whenever you visit (“Log Data”). This Log Data may include information such as your computer’s Internet Protocol (IP) address, browser type or the webpage you were visiting before you came to our Site, the pages of our Site that you visit, the time spent on those pages, information you search for on our Site, access times and dates, and other statistics. We use Log Data to monitor and analyze use of the Site and the Services and for the Site’s technical administration, to increase our Site functionality and user-friendliness, and to better tailor our Site to our visitors’ needs. We also use this information to verify that visitors to the Site meet the criteria required to process their requests.(3) CookiesLike many websites, we use “cookies” to collect information. A cookie is a small data file that we transfer to your computer’s hard disk for record-keeping purposes. We use cookies for two purposes. First, we utilize persistent cookies to save your login information for future logins to the Site. Second, we utilize session ID cookies to enable certain features of the Site, to better understand how you interact with the Site and to monitor aggregate usage by Anyplace Users and web traffic routing on the Site. Unlike persistent cookies, session cookies are deleted from your computer when you log off from the Site and Services and then close your browser. Third-party advertisers on the Site may also place or read cookies on your browser. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all portions of the Site or all functionality of the Services.(4) Web BeaconsOur Site may contain electronic images known as Web beacons (sometimes called single-pixel gifs) that are used along with cookies to compile aggregated statistics to analyze how our Site is used and may be used in some of our emails to let us know which emails and links have been opened by recipients. This allows us to gauge the effectiveness of our customer communications and marketing campaigns.
Disclosure of Personal InformationWe may employ third-party companies and individuals to facilitate our Services, to provide the Services on our behalf, to perform Site-related services (e.g., including, without limitation, maintenance services, database management, web analytics, fraud detection services relating to the activities of Anyplace Users and improvement of the Site’s features) or to assist us in analyzing how our Site and Services are used. These third parties may have access to your Personal Information; if they do, this access is only so that they may perform these tasks on our behalf and they are obligated not to disclose or use the same for any other purpose.We may also provide Personal Information to our business partners or other trusted entities for the purpose of providing you with information on goods or Services which we believe will be of interest to you. Third-party vendors, including Google, use cookies to serve ads based on an Anyplace User's prior visits to Anyplace. When we disclose Personal Information to our business partners or other trusted entities which are regarded as service providers or contractors under the laws and regulations for business purposes or commercial purposes, we enter into a contract that describes such purposes and requires the service providers or contractors to keep such Personal Information confidential and to not use it for any purpose except for performing the contract.Anyplace cooperates with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal processes (including, without limitation, subpoenas), to protect the property and rights of Anyplace or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, an illegal, unethical or legally actionable activity.We have not sold or shared any Personal Information in the preceding twelve (12) months. In this Privacy Policy, the term “sale” means disclosing, etc. your Personal Information to a third party for monetary or other valuable consideration, and the term “sharing” means disclosing your Personal Information to a third party for cross-text behavioral advertisements, whether for monetary or other valuable consideration or free of charge.
Security Measures(1) Information Safeguarding MeasuresAnyplace is very concerned with safeguarding your information. When you enter sensitive information (such as a credit card number) in our registration or order forms, we encrypt that information using secure socket layer technology (SSL). We follow generally accepted industry standards to protect the Personal Information submitted to us, both during transmission and once we receive it.We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored ‟personal data” (as defined in applicable state statutes on security breach notification) to you via email or conspicuous posting on the Site as soon as possible and without unreasonable delay, insofar as consistent with (i) the legitimate needs of law enforcement, and (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.(2) PhishingIdentity theft and the practice currently known as “OurPolicyTowardsChildren” are of great concern to Anyplace. Safeguarding information to help protect you from identity theft is a top priority. We do not and will not, at any time, request your credit card information, your Anyplace Account ID, login password, or national identification numbers in a non-secure or unsolicited e-mail or telephone communication.(3) RetentionWe retain your Personal Information to the extent necessary for the purposes stated in Section 2 “Information Collection and Use” of this Privacy Policy.The criteria for determining Anyplace retention periods, include, without limitation, the duration of the contractual relationship between you and Anyplace; the legal obligations assumed by Anyplace; and a need to perform an agreement to which you are a party.
Business TransfersAnyplace may sell, transfer or otherwise share some or all of its assets, including your Personal Information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy.
Right to Your Personal InformationThe California Consumer Privacy Act (the “CCPA”) grants rights regarding Personal Information to consumers. The following describes your rights and how to exercise those rights under the CCPA.(1) Right to Access Specific InformationYou have the right to request that Anyplace discloses certain information to you in relation to the collection, sharing, disclosure, or use of your Personal Information by Anyplace over the twelve (12) months preceding the date of your request. Upon receipt and confirmation of your verifiable consumer request, we will disclose to you any and all of the following information: (i) The categories of your Personal Information that we have collected; (ii) The categories of sources from which we have collected your Personal Information; (iii) The business or commercial purposes for the collection, sale, or sharing of such Personal Information; and (iv) The specific Personal Information that we have collected.(2) Right to Request DeletionYou have the right to request that Anyplace deletes any of your Personal Information that Anyplace has collected from you and retained, subject to certain exceptions. Upon receiving your verifiable consumer request, we will delete your Personal Information from our records and notify any service providers and contractors, as well as third parties to which we have sold or with which we have shared Personal Information, that they must delete such Personal Information from their records, unless an exception applies. We may deny your request to delete your Personal Information if it is necessary for us or our service providers or contractors to retain your Personal Information in order to: (i) Complete the transaction for which we collected the Personal Information, fulfill requirements for a product recall conducted in accordance with a written warranty or federal law, provide goods or services that you requested, enable you to take measures reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform an agreement between Anyplace and you; (ii) Provide support to ensure the security and integrity of your Personal Information to the extent reasonably and proportionally necessary for the purpose of use; (iii) Debug products to identify and repair errors that impair existing intended functionality; (iv) Exercise free speech, ensure the right of other persons to exercise their free speech rights, or exercise other rights provided by law; (v) Comply with the California Electronic Communications Privacy Act pursuant to Chapter 3.6 (commencing with Section 1546) of Title 12 of Part 2 of the Penal Code; (vi) Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres or adapts to all other applicable ethics and privacy laws, where Anyplace’s deletion of such information may render impossible or seriously impair the ability to complete such research, if you previously provided informed consent; (vii) Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us and compatible with the context in which you provided the information; or (viii) Comply with legal obligations.(3) Right to Request Correction of Inaccurate Personal InformationYou have the right to request that Anyplace corrects any inaccuracies in your Personal Information that Anyplace retains in view of the nature of the Personal Information and the purpose of processing the Personal Information. Upon receipt and confirmation of your verifiable consumer request, we will exert commercially reasonable efforts to correct any inaccurate Personal Information as you instruct, in accordance with the laws and regulations.(4) Right to Opt OutAnyplace has not and will not sell or share any Personal Information collected from you.(5) Right to Request Restriction of UseAnyplace will not use or disclose sensitive Personal Information collected from you for any purposes other than the following:
  • (i) Providing products and services that are reasonably expected by average consumers;
  • (ii) Providing support for ensuring security and integrity;
  • (iii) For short-term temporary use (except for any use involving profiling or modification for future consumer experiences);
  • (iv) Providing services on behalf of Anyplace; and
  • (v) Maintaining or improving the quality and safety of our services and devices.
(6) Right of Non-DiscriminationAnyplace shall not discriminate against you due to the exercise of any of your rights under the CCPA. Unless permitted by the CCPA, Anyplace will not engage in any of the following:
  • (i) Denying goods or services to you;
  • (ii) Charging you different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;
  • (iii) Providing you with a different level or quality of goods or services; or
  • (iv) Suggesting that you will receive a different price or rate for goods or services or a different level or quality of goods or services.
(7) Exercising Your Rights to Access, Delete, and Correct Personal InformationIn order to exercise your rights to access, delete, and correct your Personal Information, please submit a verifiable consumer request to Anyplace by contacting us via the information in “(8) Contact Information”. Only you, a natural person authorized by you, a person registered with the California Secretary of State, a person entrusted by you, or your conservator, may submit a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your child (who has not yet reached 18 years of age). A “verifiable consumer request” must:
  • (i) Provide sufficient information that allows us to reasonably verify that you are the person whose Personal Information we have collected or an authorized representative thereof; and
  • (ii) Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond thereto.
(8) Contact InformationAll Members may exercise the rights in relation to their Personal Information in their registration profile by contacting us at support@anyplace.com or editing the relevant part of their profile. If you would like us to cancel your Anyplace Account, please contact us and we will attempt to accommodate your request if we do not have any legal obligation or a legitimate business reason to retain the information contained in your Anyplace Account. Please note that, if you cancel your Anyplace Account, any reviews you have posted via the Site will remain publicly viewable via the Site.
Links to Other WebsitesOur Site contains links to other websites. If you click on another third-party link, you will be directed to that third party’s website. The fact that we link to a website or present a banner ad or other type of advertisement is not an endorsement, authorization or representation of our affiliation with that third party, nor is it an endorsement of their privacy or information security policies or practices. We do not exercise control over third-party websites. These other websites may place their own cookies or other files on your computer, collect data or solicit Personal Information from you. Other websites follow different rules regarding the use or disclosure of the Personal Information you submit to them. We encourage you to read the privacy policies or statements of the other websites you visit. Some portions of our Site implement Google Maps/Earth mapping services, including Google Maps API(s). Your use of Google Maps/Earth is subject to Google’s terms of use, which incorporates Google’s Privacy Policy.
Our Policy Towards ChildrenThe Site is not directed to individuals under 18 years of age. We do not knowingly collect personally identifiable information from children under 18. If a parent or guardian becomes aware that his or her child has provided us with Personal Information without their consent, such parent or guardian should contact us. If we become aware that a child under 18 has provided us with Personal Information, we will delete such information from our files.
International TransferPlease be aware that your information may be transferred to and maintained on computers or servers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States of America and choose to provide information to us, Anyplace transfers Personal Information to the United States of America and processes it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.
